Violation of Traffic Laws as Proof of Negligence
In an automobile accident action against a driver for damages suffered in a car collision, the driver's violation of a traffic law can be evidence of his or her negligence. The law calls negligence based upon the violation of a specific requirement of law "negligence per se." Negligence per se means that as a matter of law negligence existed. While the violation of a traffic law is negligence as a matter of law, the violation does not mean that the driver is liable unless the negligence was the proximate cause of the plaintiff's injury. Negligence is ordinarily a question for a jury. It only becomes a question of law when a court determines that only one conclusion can reasonably be drawn from the evidence. If the violation of the traffic law is treated as negligence per se, the question of negligence will not be given to the jury.
Personal Injury Protection under No-Fault Automobile Coverage
Personal injury protection ("PIP"), also known as ''no-fault benefits'' or first-party benefits, coverage is an extension of automobile insurance coverage. It pays, up to a certain amount, an insured's health care expenses and other damages, like lost wages and income continuation benefits, due to an automobile accident regardless of who was at fault. Several no-fault automobile insurance states require drivers to carry PIP coverage. In some states, insurance companies are required to offer PIP coverage. Insureds can then purchase it, if they choose.
Subrogation in Underinsured/Uninsured Motorist Cases
When an insurer pays a benefit under a policy provision for underinsured motorist coverage or uninsured motorist coverage, it is in effect paying a debt owed by the underinsured or uninsured driver, the person who is actually liable for the damages arising as a result of the event that led to the insurer having to make the payment. An insurer who makes such payments has a right, the right of subrogation, by which it is permitted to take legal action against the underinsured or uninsured motorist in an attempt to recover as much as possible of the amount the insurer has paid out. The insurer's subrogation right will only have value, as a practical matter, to the extent that the underinsured or uninsured driver has assets that can be seized by legal process to satisfy the judgment that the insurer obtains against the underinsured or uninsured driver in its subrogation action.
Coverage For Employees Operating Vehicles Within the Course of Employment
Vehicles are very important for the conduct of business. From making deliveries to taking employees on sales calls, employers often make vehicles available to employees to use in the course of their employment. Corporate insureds can obtain fleet insurance for motor vehicles from their automobile insurance company. That insurance generally covers injury, damage, or theft of owned or leased vehicles. It also provides coverage to the corporate insured if its employees are involved in an accident while driving a fleet vehicle on company business. A fleet insurance policy will cover a number of vehicles in one policy that are owned or leased by one corporate insured.
Design Defects in Automotive Products Liability Cases
The basic elements of proof that a plaintiff in a products liability action against the manufacturer or seller of a car or truck has to establish are that the vehicle as sold contained a defect that created an unreasonable risk of death, personal injury, or property damage when the vehicle was used for its intended purpose and that the defect caused an accident or similar incident, such as a vehicle fire, that resulted in the loss for which the plaintiff is seeking to recover damages. Allegations of product defect in automotive products liability cases include inadequacies in vehicle design, errors in the manufacture of vehicle parts and their assembly into a completed car or truck, and failure to warn users of a vehicle about dangers inherent in its use.
